In a wrongful death suit our client is the personal representative of the deceased's estate. Wrongful death actions are brought on behalf of the survivors, not to recover for injuries to the deceased, but to recover for statutorily identified losses the survivors have suffered directly as a result of the death. The personal representative who is named in a will or a responsible member of the family like mom or dad or a surviving adult child. If no one in the family volunteers to be the personal representative or if no one is available to serve as PR the court will appoint someone outside of the family to represent the estate and the survivors.

Brief time limit in Florida bars recovery

If you don't bring a legal claim within 2 years of from the date of your loved one's death you are barred forever from recovering money damages for the negligence that caused this premature death. Your are barred from recovering damages for the survivors and the estate of the loved one.

How long does it take

Once a law suit is filed the Florida Supreme Court estimates it should only take no longer than 18 months.

Damages for Wrongful Death

The value of a life is inestimable. It cannot be measured even though the law requires money damages be paid to the next of kin for their pain mental anguish and loss as a consequence of the death. The money damages also include payment of funeral expense, medical bills, ambulance, and loss of financial support and services.

We negotiate on the premise that a jury will calculate money damages to make up for the survivors loss. Whatever money damages a jury awards to the next of kin it can never be enough. To accomplish the judicial requirement that a family receives money damages for their loss the court instructs the jury to write down on the verdict form a dollar amount to cover it. It's because the value of a life is inestimable and grief of the survivors persists we urge the family not to hastily enter into early and likely inadequate insurance settlement.
