In accident cases, a wrongful death is an accidental death when someone's negligent conduct causes injury to another
person that leads to premature death. We thoroughly and caringly investigate and prepare wrongful death claims.
What we can do for you
Respectfully, we provide you the means and legal skill to hold the person or corporation responsible for the death of
your loved one. We provide the means to recover money damages for the benefit of the survivors. I am a trial lawyer and a member of the Florida bar. I help people everyday as a consequence of
my profession and it would be my honor to help you now.
Personal Representative of the Loved One is Our Client
In a wrongful death suit our client is the personal representative of the loved one's estate. This is the person
named in a will or a responsible member of the family like mom or dad or a surviving adult child. If no one
in the family volunteers to be the personal representative or no one is available the court will appoint
someone outside of the family to represent the estate and the survivors. The money damages in settlement or
awarded by a jury in a law suit are for the benefit of the survivors and the estate. Only a personal
representative can authorize settlement in a wrongful death case.
Brief time limit in Florida bars recovery
If you don't bring a legal claim within 2 years of from the date of your loved one's death you are barred
forever from recovering money damages for the negligence that caused this premature death. Your are barred from recovering
damages for the survivors and the estate of the loved one.
How long does it take
Once a law suit is filed the Florida Supreme Court estimates it should only take no longer than 18 months.
Damages for Wrongful Death
The value of a life is inestimable. It cannot be measured even though the law requires money damages be paid
to the next of kin for their pain mental anguish and loss as a consequence of the death.
The money damages also include payment of funeral expense, medical bills, ambulance, and
loss of financial support and services.
We negotiate on the premise that a jury will calculate money damages to make up for the survivors loss.
Whatever money damages a jury awards to the next of kin it can never be enough.
To accomplish the judicial requirement that a family receives money damages for their loss the court
instructs the jury to write down on the verdict form a dollar amount to cover it.
Money is the only substitute the law recognizes for the damages suffered in these cases.
Whatever Amount the Insurance Company Pays is Not Enough
It's because the value of a life is inestimable and grief of the survivors persists we urge
the family not to hastily enter into early and likely inadequate insurance settlement.
We ask of you to allow us to fully investigate and develop your case so we can present you with adequate
information to make an informed decision whether to accept or reject an insurance offer to settle the case.
Caution Against Haste Allow Preparation and Investigation
No attorney can tell you with any degree of reliability the value of a wrongful death case before he or she has
adequately and fully developed the case. We fully investigate to determine insurance coverage and the negligent cause of
the premature death. After we are fully satisfied with the investigation we present our finding to you so you have
the opportunity to make an informed decision as to any settlement offer.
Prudent to Wait to Settle Most of the Time but Not Always
The only wrongful death cases that should quickly settle are those where liability issues exist or insurance
coverage is limited.
